Attorneys Association “Bauman & Kondratyuk” (hereinafter — the “Firm”, “we”, “us”) respects your right to privacy and ensures the protection of personal data in accordance with the Law of Ukraine “On Personal Data Protection” of 01 June 2010 No. 2297-VI, the Constitution of Ukraine, other regulatory legal acts of Ukraine, and — to the extent applicable to EU residents — Regulation (EU) 2016/679 (GDPR). This Privacy Policy (the “Policy”) explains what personal data we process, for what purposes, on what legal grounds, how long we retain it, and what rights you have.

1. Data controller

2. Categories of personal data we process

Depending on the nature of your interaction with the Firm, we may process the following categories of personal data:

  • Identification data: surname, given name, patronymic, date of birth, taxpayer registration number, passport details.
  • Contact data: postal address, email address, telephone number.
  • Professional data: position, name of the legal entity you represent and its identification code.
  • Data related to the provision of legal assistance: the content of your enquiries, documents provided by you or obtained in the client’s interest, information about the circumstances of the matter.
  • Payment data: bank details for issuing invoices and receiving payment (we do not store payment card data).
  • Technical data: IP address, browser type and version, operating system, language, date and time of visit, pages viewed, referrer, cookies (see section 8).

We do not knowingly collect personal data of persons under the age of 18. If you become aware of such processing, please notify us and we will promptly delete the data.

3. Purposes of processing

We process personal data solely for the following purposes:

  • conclusion and performance of legal services agreements, handling of client matters, representation of interests;
  • mandatory client identification and verification (KYC, AML) in accordance with the Law of Ukraine “On Prevention and Counteraction to Legalisation (Laundering) of Proceeds of Crime” of 06 December 2019 No. 361-IX;
  • compliance with attorney obligations under the Law of Ukraine “On the Bar and Practice of Law” of 05 July 2012 No. 5076-VI, including preservation of attorney-client privilege;
  • accounting and tax reporting, invoicing, compliance with tax and financial legislation;
  • responding to enquiries submitted via the website contact forms, email, or telephone;
  • sending informational newsletters and legislative updates — subject to your consent;
  • ensuring the security, proper functioning, and analytics of the website bkadvisers.com.ua;
  • protecting the rights and legitimate interests of the Firm, including in pre-trial dispute resolution and court proceedings.

4. Legal grounds for processing

Personal data is processed on one or more of the following grounds (Article 11 of the Law of Ukraine “On Personal Data Protection”; Article 6 GDPR):

  • consent of the data subject;
  • necessity for the performance of a contract to which the data subject is a party, or for taking steps at the data subject’s request prior to entering into a contract;
  • compliance by the Firm with legal obligations (KYC/AML, tax, accounting, procedural);
  • protection of vital interests of the data subject or another person;
  • legitimate interests of the Firm or a third party, where such interests override the rights and interests of the data subject.

5. Disclosure of personal data to third parties

We do not sell personal data. Disclosure is possible only in the following cases:

  • to courts, state authorities, notaries and state registrars — within the scope of client representation or as required by law;
  • to auditors, banks, providers of accounting, IT and cloud services — under confidentiality terms and with adequate data protection safeguards;
  • to foreign legal counsel — subject to the client’s explicit consent and only to the extent necessary for the provision of legal assistance;
  • in other cases expressly provided by the legislation of Ukraine.

Cross-border transfers of data are carried out only to jurisdictions that ensure an adequate level of personal data protection, or on the basis of standard contractual clauses provided by GDPR.

6. Retention periods

Personal data is retained only for the time necessary to achieve the purposes of processing, in particular:

  • client data and case files — for the term of the legal services agreement and for 5 (five) years after its termination, unless otherwise required by law or agreed by the parties;
  • data subject to retention under attorney law, financial monitoring, accounting and archival legislation — for the periods prescribed by the respective regulatory acts;
  • data from website contact forms — for up to 12 months from the date of enquiry, where the communication does not result in contractual relations;
  • data processed on the basis of consent (e.g. newsletters) — until the consent is withdrawn.

7. Rights of the data subject

Pursuant to Article 8 of the Law of Ukraine “On Personal Data Protection” and Articles 15–22 GDPR, you have the right to:

  • know the sources from which your personal data are collected, their location, the purposes of processing, their composition and content;
  • receive information on the conditions of access to the data and on their disclosure to third parties;
  • access your personal data;
  • request rectification, erasure (where legally justified), or restriction of processing;
  • withdraw consent previously given for processing;
  • object to processing based on legitimate interests;
  • data portability — in cases provided by GDPR;
  • lodge a complaint with the Ukrainian Parliament Commissioner for Human Rights or a competent court.

8. Cookies and analytics

The bkadvisers.com.ua website uses cookies to ensure basic functionality, preserve language preferences and gather analytics. Strictly necessary cookies are set without separate consent; analytical and marketing cookies are set only after you give consent through the website banner. You may change cookie settings in your browser or withdraw consent at any time.

9. Data protection measures

The Firm applies organisational and technical safeguards appropriate to the nature of the data processed: access controls, encryption of transmission channels (TLS), backups, secure document storage, and staff training. Attorney-client privilege is preserved to the full extent provided by Article 22 of the Law of Ukraine “On the Bar and Practice of Law”.

10. Amendments to the Policy

We may update this Policy from time to time. The current version is always published at bkadvisers.com.ua/en/privacy-policy. The edition date appears at the beginning of the document. Material changes are additionally communicated to clients by email.
